Thank you all for the comments, I may call on you Bob depending on how things go. Good job I have photos as I’ve had a letter of Tesco (their insurance) asking a few questions and stating that according to what they have been told it’s my fault??

I would say you are lucky! The car can be fixed. It's good there aren't injuries. There are so many procedures to follow when people are heart. Last summer, my cousin hit a boy on the pedestrian crossing. It wasn't something serious, but the parents sued my cousin. At first, they wanted him to pay the moral damages. After that, they requested a full recovery for their boy at a luxury hospital. We decided it was the right time to contact lawyers. The specialists from puschnguyen.com helped us in court. They demonstrated there is no need for such a treatment. The judges agreed that the parents wanted to take advantage of our family.

They will always try that, I think its a default response. Blame the other party and see if they fold. Just stick to your guns and provide facts and evidence and they will change there tune.

Yes, I had the same from the other driver’s insurance many years ago when the driver hit my E36; I was with my baby daughter at the time in a proper baby seat, he was absolutely drunk as a skunk, didn’t use his seatbelt and smashed his head on his windscreen with the impact of hitting the back of mine as I waited at a red light, don’t put any thought into that statement.

I know we are going off topic a little, but I had a similar funny one. Guy on a roundabout, 3 lanes I was on the outside lane in my old car, guy next to me pulled forward and straight lined the roundabout swiping the side of my car. He claimed it was my fault, as above, when we provided a drawing of the road layout to prove this he had got completely the wrong junction on the roundabout and claimed I was coming from a completely different direction. As soon as the insurance companies saw this it was settled and he was 100% responsible.

Well, good news they are going to repair. They asked for a photo of each corner and commented on its good condition they also, without being asked by me looked up similar Alpina car prices and decided to fix. They are happy to leave the car on my drive while they collect the parts that they see are damaged and then call it forward. So far so good. Sent the KIA Sportage back, just couldn’t get on with it.

Just keeping the thread up to date, after 3 months and 10 days the car was finally lifted of my drive and is of to the body shop. I also contacted my insurance as I will have to pay the £200 excess when it’s finished at the body shop. They inform me that they will reimburse me if the accident wasn’t my fault which they know wasn’t but they are still waiting a response from the other party’s insurance. Apparently the whole thing can take 6/7 months?

It’s good news regarding the repairs.
After my ‘incident’ the other driver’s insurance company started to play hard. I had legal assistance and my insurance company brought in an independent accident investigator to the scene and he produced an expert witness report as evidence too. His insurance settled everything just before it went legal/court proceedings, absolutely wasted everyone’s time and money there in an attempt to claim blame was shared, but the Police were involved at the scene too so they really didn’t have a chance.
My E36 had a new boot floor panel, boot lid etc, took 2 months for the repairs, then it did take around 6 months to be finally settled, even a payment to my employer due to a couple of days sick with a sore neck.

Got the car back today, don’t she look great NOT. The bonnet which was supposed to turn up yesterday is now on back order along with some other parts. So who knows how long this will take. I’m still pleased the car is being fixed even though it may be a long haul.

I feel for you Henry. Ridiculous delays and wasteful legal argument all add to the cost of everyone's insurance. Have you been provided with a replacement car all this time and at inflated rates?

To be fair they gave me a KIA Sportage, a barge on wheels which I gave back as I was never going to use it as opposed to an m3/4.6 X5/vw r32. I don’t think it would have speeded up the spare parts arriving if I’d kept it.
