Built to my spec and collected by me from the Buchloe factory in October 2014. I now think that's exactly what it is - coincidentally I have just today had an email exchange with the factory in which they make the same suggestion. They also say that there is no ECU-operated or other flap in the exhaust and no 'artificial' noise generation.

FWIW I've done 7,000+ miles in my D4 (collected on 24th Sept) and I'm getting a genuine 39 mpg. Driven at the same pace my last car, a 635d, was giving 32 mpg.
